Terms of Service
0. Introduction
EZYCLOUDX provides compute infrastructure services (GPU Cloud, servers, storage), covering hardware and infrastructure resources (CPU, GPU, RAM, storage, network) and excluding software. These terms set out the rights and obligations of the customer and EZYCLOUDX while the service is used.
By signing up for or using the service, the customer is deemed to have accepted all of the terms below.
1. Definitions
Service: The services EZYCLOUDX provides, including but not limited to GPU Cloud, servers and storage.
Customer: The individual or organisation that signs up for the service.
Data: All data the customer stores or processes on the platform.
2. The customer's responsibilities
2.1. Lawful use
Customers undertake to use the service lawfully and not for any of the following:
Network attacks: DDoS, building botnets, exploiting security vulnerabilities, unauthorised IP/port scanning, or interfering with third-party computer systems.
Fraud & impersonation: Phishing, scams, or impersonating other individuals or organisations.
Malware & spam: Storing or distributing viruses, trojans or malware; sending bulk spam email; game spam that harms the reputation of our IP ranges.
Illegal content: Storing or distributing copyright-infringing material or software (DMCA), obscene content, child sexual abuse material, or any material or information that breaches the laws and security of the Socialist Republic of Vietnam.
Gambling: Organising, operating or taking part in gambling, betting or lottery systems in any form.
Cryptocurrency mining: Using Cloud/VPS to mine cryptocurrency in any form is strictly forbidden, because it consumes hardware resources continuously.
Note: The customer is responsible for everything they do with the service and for the data they store, transmit or process through it. EZYCLOUDX has no obligation to actively police that activity or content, and to the fullest extent permitted by law is not liable for breaches originating with the customer.
2.2. Software licensing (BYOL)
EZYCLOUDX operates on a BYOL (Bring Your Own License) model.
- Operating system & software: The customer is responsible for holding a valid licence for all software installed or used on the service, including the operating system and applications.
- Compliance: The customer agrees to comply with the End User Licence Agreements (EULAs) of the software they use.
- Pre-installation on request: EZYCLOUDX may pre-install an operating system on the VM according to the customer's choice at sign-up, to save setup time. By choosing a licensed operating system (Windows, for example), the customer confirms they hold a valid licence and undertakes to activate it after renting. EZYCLOUDX performs the installation as a technical agent on the customer's instruction and takes no responsibility for licence validity. Once the rental session ends, every activated software licence is removed entirely from EZYCLOUDX.
Note: EZYCLOUDX provides compute infrastructure (CPU, GPU, RAM, storage, network). All software installed on the VM — including the operating system — is the customer's own responsibility as regards licensing and legality during their rental session. EZYCLOUDX does not supply, warrant or take responsibility for any software licence.
2.3. Account security
Customers are responsible for keeping their login details secure. Any activity from an account is treated as the customer's own.
2.4. Data protection
Customers are responsible for backing up and protecting their own data. EZYCLOUDX is not liable for data loss caused by the customer or a third party.
EZYCLOUDX is not liable for data loss, business interruption or damages arising from the customer's failure to back up data regularly.
2.5. Remote access
The customer is responsible for granting third parties access.
2.6. Acceptance of these terms
By creating an account you agree to be bound by these terms and by our privacy policy. If you are under 18, you may only use the service with the consent and supervision of a parent or legal guardian. If you do not agree with any part of these terms, please do not use our service.
2.7. Computing Points & how usage is measured
EZYCLOUDX uses the Computing Point system ( CP) as the unit for measuring resource consumption on the EZYCLOUDX platform. Computing Points are not currency, have no exchange value against any currency, and may not be bought, sold or traded between users on the platform. They can only be bought directly from EZYCLOUDX and only used for services on the platform. See Computing Points & how usage is measured.
3. EZYCLOUDX's responsibilities
3.1. Service provision
EZYCLOUDX provides cloud infrastructure services as described and makes reasonable efforts to keep them stable.
3.2. Information security
We are committed to protecting customers' personal information and will disclose it only on a lawful request from a competent authority or with the customer's consent.
3.3. Support
EZYCLOUDX supports customers by email, phone and social media. Response times vary with the severity of the problem.
3.4. Limits of the service
EZYCLOUDX is not liable for incidents arising from:
- •Misconfiguration on the customer's side
- •Software or systems supplied by a third party
- •Unauthorised access beyond our reasonable control
4. Service suspension and termination
4.1. Service suspension
EZYCLOUDX may suspend the service in the following cases:
Serious breaches (attacks, fraud, malware, unlawful activity, etc.): immediate suspension
Other breaches: a warning may be given first
4.2. Service termination
The service may be terminated when:
- •The service expires and is not renewed
- •The customer breaches these terms
4.3. Termination by the customer
Customers can stop using the service at any time by not renewing or by submitting a cancellation request.
4.4. Data on termination
Data becomes inaccessible as soon as the service ends. Depending on the storage infrastructure, it may be deleted immediately or held for up to 7 days before permanent deletion. After that it cannot be recovered.
5. Limitation and exclusion of liability
EZYCLOUDX is not liable for indirect damages, lost profits or lost data.
To the fullest extent permitted by law, EZYCLOUDX is not liable for incidents beyond its control.
EZYCLOUDX does not guarantee uninterrupted service; downtime can occur during maintenance, upgrades or unforeseen incidents.
EZYCLOUDX's total liability (if any) will not exceed the amount the customer paid in the most recent one (1) month.
6. Payment
Customers can pay by bank transfer or any other method offered on the platform. See the payment policy for more.
6.1. Computing Point & refund policy
- • Computing Point refund: when a machine suffers a technical fault or loses connectivity because of EZYCLOUDX — the points deducted during the fault are refunded and the customer keeps the service.
- • Bank refund: when the customer wants to terminate the service and EZYCLOUDX could not resolve a connection fault within 24 hours, or EZYCLOUDX delivered a specification that does not match the description.
- • No compensation: faults on the customer's side, third-party software that does not work, promotional Computing Points, breaches of these terms, and similar cases.

7. Force majeure
In the event of force majeure (natural disaster, power failure, infrastructure incident, etc.), neither party is liable for the period affected.
8. Governing law
These terms are governed by the law of the Socialist Republic of Vietnam. Any dispute will be resolved by the competent courts of Ho Chi Minh City.
9. Service updates and changes
EZYCLOUDX may change, upgrade or discontinue part of the service over time in line with its development plans. Significant changes will be announced on the website, by email, or through other contact channels.

These terms of service may be adjusted and updated from time to time to keep pace with the latest requirements and standards. Customers are responsible for following the official website so they remain compliant with the current rules.
